These terms are an agreement between you, the person or organisation using the service ("you"), and ScriptWatcher ("we", "us"). They cover the ScriptWatcher website and service. By creating an account or using the service you accept them. If you are accepting on behalf of an organisation, you confirm you are allowed to do that and the organisation is bound by them too.
ScriptWatcher fetches web pages you nominate, records which script files those pages load, stores copies of those files, and compares what it finds on each later visit against what it found before. It keeps the reasons you give for accepting changes.
It is important to be clear about the boundaries of that:
No responsibility for this product rests with its author. The service is provided "as is" and "as available". You must satisfy yourself that it functions in the way you want it to, and you must keep satisfying yourself of that for as long as you rely on it. That responsibility starts with you, stays with you, and is not transferred to us by your use of the service or by anything we have published about it.
The service does not purport to be fit for any specific purpose. No representation or warranty is given, express or implied, as to fitness for a particular purpose, merchantability, satisfactory quality, accuracy, completeness, availability, or uninterrupted or error-free operation, except where the law does not allow such a warranty to be excluded.
It is not medical grade and it is not aerospace grade. It has not been designed, built, tested or certified to any safety-critical standard, and it is as susceptible to errors, defects, interruption and outright failure as any other technical product. It must not be used as the only control protecting anything that matters, and must not be relied on where a failure, a missed change, a false alarm or an interruption could cause injury, loss of life, environmental harm, or significant financial or operational loss.
Among the things that can go wrong, and for which no liability is accepted: a check may not run; it may fail to fetch a page or a file; it may miss a change; it may report a change that did not happen; a classification may be wrong in either direction; an email alert may be delayed, filtered or never delivered; stored data may be lost; and the service may be unavailable or discontinued.
Enterprise alternatives. If your needs call for something more robust than this, a more resilient solution can be custom made and provided on request. Get in touch at [email protected] and describe what you need and what it has to withstand.
To the fullest extent the law permits, we are not liable to you for any indirect or consequential loss, or for any loss of profit, revenue, business, goodwill, anticipated savings, or data, however caused, whether under contract, tort (including negligence), statute or otherwise, and whether or not we were told such loss was possible.
Where liability cannot be excluded, our total liability to you for all claims taken together is limited to the amount you actually paid us in the three months before the event that led to the claim, or £50, whichever is greater. On a free plan that limit is £50.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.
You agree that:
Checks are made from our servers, identify themselves with a ScriptWatcher user agent, and are made roughly once a day per page plus whenever you ask for one. If that traffic is unwelcome on your infrastructure, do not add the page. We make no promise about the exact time of day a check runs, or that one runs every day without fail.
Paid plans are billed monthly in advance through Stripe. Card details are handled by Stripe and never reach our servers. Prices are shown before you buy and exclude VAT or other taxes where those apply.
You can cancel at any time from the billing page. Cancelling stops the next payment; it does not refund the current period, and you keep access until the period you have paid for ends. We do not generally give refunds for time you did not use, though we will look at anything that is obviously our fault. If a payment fails and stays unpaid, the account drops back to the free plan limits rather than being deleted.
We may change prices. If you are on a paid plan we will tell you by email at least 30 days before a change affects you, and you can cancel instead.
The records you create stay yours: the sites and pages you add, the reasons you write, and the history that builds up. We store them to run the service, and handle personal data as described in the privacy policy.
The service itself, including the software, the design and the wording, stays ours. You get the right to use it while your account is open, and nothing more.
Note that the service stores copies of script files fetched from the pages you nominate. Those files may belong to you or to a third party. You confirm you are entitled to have copies kept for the purpose of monitoring your own pages.
You can close your account whenever you want, which deletes your records. We may suspend or close an account that breaks these terms, that is being used to monitor sites without permission, that is not paid for, or where we are required to. Where it is reasonable to do so we will warn you first and give you a chance to export your data.
We may also stop offering the service altogether. If that happens we will give paid accounts at least 30 days' notice by email and a window to export, and refund any period paid for but not provided.
We may update these terms. The date at the top shows when they last changed. For changes that materially reduce your rights we will email account holders. Carrying on using the service after a change means you accept the updated terms; if you do not, close your account.
If a part of these terms turns out to be unenforceable, the rest still stands. Not enforcing something straight away does not mean we have given it up. You may not transfer your rights under these terms without our agreement; we may transfer ours if the service changes hands, on the same terms. These terms are the whole agreement between us about the service, and they are governed by the law of England and Wales, with the courts of England and Wales having jurisdiction. If you are a consumer elsewhere, you keep any rights you have under your own local law.
Email [email protected] with anything about these terms, about your account, or about having something more robust built.
